Terms and Conditions

Celtic Whiskey Auction - Terms of Service

Please carefully read this Agreement as it governs your use of the Celtic Whiskey Auction website, www.celticwhiskeyauction.com ("the Site"). By continuing to use the Site, you agree to these terms and confirm that you are above the legal drinking age in Ireland, which is currently 18 years of age. Individuals under the legal age are prohibited from purchasing, receiving, or subscribing to any goods or services from the Site.

1. Provision of Web Site Service

The Site is operated by Celtic Whiskey Shop Ltd. (Company No: 367358, VAT Reg. No. IE6387358K), with its registered office at 27-28 Dawson Street, Dublin 2, Ireland (hereinafter referred to as "the Company").

2. Limited Rights to Use Content

All material, including any intellectual property on the Site, is owned by the Company or its suppliers. You may:

  • Retrieve and display the content on your PC screen.
  • Print individual pages for personal use.
  • Store individual pages in electronic format.

However, you cannot:

  • Redistribute or supply content to others without prior written permission.
  • Remove copyright or trademark notices from copies.
  • Create a database by downloading or storing content.
  • Modify, reproduce, or use content in any other way not expressly stated in this agreement.

3. The Auction

We provide auction services for the sale of whisky and other alcoholic goods. These goods are auctioned in lots, which are defined as items made available for purchase at a specific time. The auction operates in collaboration with Smith Kelly Scott Auctioneers (smithkellyscott.ie).

  • Registration: Both sellers and buyers must register on the Site to participate in the auction.
  • Authentication: We assess the quality, condition, and authenticity of auctioned goods. If items are deemed problematic, we reserve the right to remove them from the auction, and they will be returned to you at your cost.
  • Sellers’ Responsibility: Sellers must ensure all submitted information is accurate. Inaccurate descriptions may result in rejection by the buyer, with the seller responsible for related costs.

4. Bidding

  • Bidding is only permitted by registered users.
  • Prohibited Practices: Bidding on your own items or using third parties to do so is forbidden. We may cancel such bids and return the goods to the seller at the seller's expense.

5. Holding Your Goods

Items provided to Celtic Whiskey Auctions are stored in our facilities. We do not accept liability for the safe storage or preservation of items while in our custody. Sellers should have appropriate insurance in place.

6. Selling Costs & Commission

  • Listing Fee: €5.00 per lot.
  • Reserve Fee: Optional, €5.00 per lot.
  • Commission: Sellers pay 5% of the final purchase price, reducing to 3.5% for items sold for over €2000.
  • VAT: 23% VAT applies on the commission, listing, and reserve fees.

7. Payment to Sellers

Sellers will receive payment within 30 days after the buyer has received the goods, provided no cancellation rights have been exercised. Payment is made once all sums due from the buyer have been received.

8. Information & Terms for Buyers

  • After successful registration, buyers can place bids.
  • Bid Confirmation: Once a bid is placed, it is final and binding. Bids cannot be retracted or amended.
  • Winning Bid: The highest bid at the auction's close is the winning bid. A confirmatory email will be sent to the winning buyer.
  • Buyer's Commission: A 10% commission is added to the purchase price. VAT (21%) applies to the commission but not the hammer price.

9. Payment from Buyers

  • Payment must be made within 7 days after the auction closes.
  • Payment Methods: Bank transfer, PayPal, debit/credit cards. A 2% surcharge applies to credit card payments.
  • Late Payment: If payment is not received within the due date, late payment interest at a rate of 3% above the prevailing Central Bank base rate will apply.

10. Age Restrictions

  • You must be 18 years old (or the legal age in your country of residence) to use the Site for buying or selling alcoholic goods.
  • We reserve the right to ask for identification to verify the purchaser's age.

11. Delivery

  • Delivery is offered through third-party logistics providers.
  • Risk: We exclude all liability for damage, leakage, or deterioration during transit.
  • Buyers can choose to pick up their items from our premises (free storage for 14 days). After this, a €2.00 per bottle per day storage fee applies.

12. Cancellation, Returns & Refunds

  • No Returns: Consumer protection distance selling rights do not apply to auctioned items. No returns or cancellations are accepted.
  • Condition of Goods: Due to the nature of some auction items, damages (e.g., torn labels, damaged boxes) may be present. The buyer accepts these conditions when placing a bid.

13. Force Majeure

Neither party shall be liable for failure to perform due to events beyond their control, including natural disasters, terrorism, or civil unrest.

14. Waiver

Failure by either party to enforce any provision of this Agreement does not constitute a waiver.

15. Data Protection and Cookie Policy

We are committed to protecting your personal data. Our use of your data is governed by our Privacy Policy.

16. Modifications to Content

The Company reserves the right to change the Site content, including the Terms & Conditions, prices, and products at any time without notice. You will be subject to the terms and policies in place at the time of your visit.

17. General Terms

  • No Time Limit: The Site may be used indefinitely, but the Company reserves the right to suspend or terminate access at any time.
  • Jurisdiction: This Agreement is governed by Irish law. Both parties agree to submit to the exclusive jurisdiction of the Irish Courts.
